Supported by the courts and increasingly common, many companies will attempt mediation prior to or after commencement of court or similar proceedings.

Many mediations are successful in that they will lead to a settlement or will start a process that will subsequently lead to a settlement. Even if no settlement is reached, the costs of a one day mediation, for example, are fairly small relative to the cost of arbitration/litigation or similar so is often worth undertaking.

Parties can attempt mediation with or without their legal advisers but the parties need to be clear about their options and intended outcomes.
